B3 Construction Consultancy Limited ("B3") provides professional building surveying services to our valued Clients. These Terms and Conditions ("Terms") govern the engagement between B3 and the Client ("you") for the provision of such services. Please read these Terms carefully before engaging B3 for any services.
1. Acceptance of Terms
By engaging B3, you confirm your acceptance of and agreement to be bound by these Terms. These Terms supersede any prior agreements or understandings, whether written or verbal.
2. Services Provided
B3 offers a comprehensive range of building surveying services, including but not limited to:
- Building surveys (e.g., homebuyer, condition, valuation)
- Structural engineering assessments
- Damp and timber surveys
- Party wall matters
- Project management
- Design and specification services
- Building regulations applications
The specific services to be provided will be outlined in a separate engagement letter, further detailing the project scope, timeframe, and fees.
3. Client Responsibilities
You are responsible for:
- Providing B3 with all necessary information and timely access to the property.
- Obtaining any requisite consents or permissions from relevant authorities.
- Complying with all applicable laws and regulations.
- Making full and prompt payment for services rendered.
4. Fees and Payment
Fees for B3's services will be specified in the engagement letter. Depending on the project's nature and complexity, fees may be fixed, hourly, or based on a pre-determined scale.
Payment terms will also be clearly stated in the engagement letter. Typically, B3 requires a deposit upon engagement acceptance and progress payments throughout the project, with the final balance due upon service completion.
5. Disclaimers and Limitations of Liability
B3's services are provided "as is" without express or implied warranties of any kind. B3 disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
B3's liability for any loss or damage arising from or in connection with its services shall be limited to the sum of fees paid by you for the specific project giving rise to the claim. B3 shall not be liable for any consequential, indirect, incidental, or punitive damages.
6. Intellectual Property
All reports, drawings, and other documents created by B3 remain its intellectual property. You are granted a non-exclusive licence to use these materials solely for the specific project.
7. Confidentiality
B3 maintains the utmost confidentiality with all information received from you. We will not disclose any confidential information to any third party without your prior written consent, except as required by law.
8. Termination
Either party may terminate the engagement upon written notice to the other. You shall be liable for any fees incurred by B3 up to the termination date.
9. Force Majeure
B3 shall not be liable for any delays or failures in performing its obligations due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, strikes, or government regulations.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of England and Wales.
11. Entire Agreement
These Terms constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
12. Severability
If any provision of these Terms is held invalid or unenforceable, such provision shall be struck, and the remaining provisions shall remain in full force and effect.
13. Notices
All notices and other communications hereunder shall be in writing and shall be deemed to have been duly given when delivered personally, sent by certified or registered mail, postage prepaid, return receipt requested, or sent by overnight courier, addressed as follows:

14. Waiver
No waiver by either party of any breach or default hereunder shall be deemed a waiver of any other or subsequent breach or default.
15. Headings
The headings in these Terms are for convenience only and shall not affect the construction or interpretation of these Terms.
16. Complaints Resolution Procedure
B3 Construction Consultancy Limited ("B3") is unwaveringly committed to upholding the highest standards of client service and satisfaction. We value your feedback and consider it an essential component of our continuous improvement process. To ensure your concerns are addressed promptly, fairly, and professionally, we have established a comprehensive complaints resolution procedure.
Initial Resolution — Communicating Directly
We encourage you to initially raise any concerns directly with the designated surveyor or project manager assigned to your project. They are well-positioned to understand the specifics of your project and seek a timely and amicable resolution through open communication and a thorough understanding of your perspective.
Formal Complaint — Escalating Your Concerns
If you are not fully satisfied with the outcome of the initial resolution stage, or if you prefer to escalate the matter, please submit a formal written complaint to the Managing Director of B3 at info@b3-cc.co.uk.
Within your formal complaint, please provide a clear and concise description of the nature of your concerns, along with relevant details and substantiating evidence. This information will enable us to conduct a thorough investigation and seek an appropriate resolution.
Investigation — Gathering Information and Insights
Upon receipt of your formal complaint, B3 will acknowledge it within 5 working days and initiate a comprehensive investigation. This may involve:
- Seeking further information or clarification from you or other relevant parties.
- Reviewing pertinent documents and project records.
- Consulting with involved professionals or experts.
Response and Resolution — Findings and Next Steps
B3 will provide you with a detailed written response to your complaint within 15 working days of receipt. The response will outline the following:
- Key findings of the investigation.
- Any proposed resolutions or remedies to address your concerns.
- Clear next steps and timelines for implementation.
Mediation — Seeking Impartial Assistance
If you remain dissatisfied with B3's response, you may request mediation through an independent mediator mutually agreed upon by both parties. This process aims to facilitate open dialogue and reach a mutually acceptable resolution under the guidance of an impartial third party.
External Redress — Elevating Your Concerns
Should mediation prove unsuccessful, you retain the right to pursue external redress through:
